    Alamy SAN FRANCISCO -- Apple (AAPL) has cut in half the time it takes to give refunds to online store customers who want to return their iPhones and other gadgets, a small but crucial step to try to get more people to buy direct from its website. The move is a big upfront expense on Apple's part, but could pay off in the long run if the company can lure online customers away from retailers such as Amazon.com (AMZN) and Best Buy (BBY), industry experts say. According to retail-intelligence firm StellaService, customers who buy a product from Apple's online store can get a refund in under a week, versus 10 days previously. Apple is processing refunds at a faster rate because the company now uses an expedited service, FedEx 2Day, to let customers ship returned items with prepaid labels to its warehouse in three days. StellaService researchers first noted the improvement in refund processing times in November, but chalked it up to a temporary measure for the busy holiday season. The company, which orders items from Apple's website several times a day for research purposes, also discovered that packages were stamped with FedEx 2Day, rather than a Newgistics prepaid label. A source with knowledge of the new procedure confirmed that customers will incur no additional cost. "This is the first time we're seeing an investment like this on the returns side," Kevon Hills, StellaService's vice president of research, told Reuters. StellaService does business with Amazon-owned Zappos, but declined to disclose whether its customer base included Apple, Amazon or eBay (EBAY). Amazon remains the frontrunner in online retail, but the race is heating up. Nike Gains On Upbeat Earnings; Dollar General Shares Slip

Entering the final hour of trading on Friday, the Dow traded down 0.22 percent to 16,809.53 while the NASDAQ gained 0..20 percent to 4,387.18. The S&P also fell, dropping 0.08 percent to 1,955.56.

Leading and Lagging Sectors

In trading on Friday, technology shares were relative leaders, up on the day by about 0.31 percent. Top gainers in the sector included Aware (NASDAQ: AWRE), up 15.4 percent, and Progress Software (NASDAQ: PRGS), up 7.7 percent.

Energy shares dropped around 0.22 percent in today’s trading. Top decliners in the sector included Daqo New Energy (NYSE: DQ), PDC Energy (NASDAQ: PDCE), and YPF SA (NYSE: YPF).

Top Headline

Finish Line (NASDAQ: FINL) reported better-than-expected fiscal first-quarter earnings.

Finish Line’s quarterly profit surged to $12.4 million, or $0.25 per share, versus a year-ago profit of $5.1 million, or $0.10 per share. Excluding certain items, it earned $0.28 per share.

Its sales climbed 16% to $406.5 million. However, analysts were projecting earnings of $0.21 per share on sales of $394 million.

Equities Trading UP

Progress Software (NASDAQ: PRGS) shares shot up 8 percent to $24.02 after the company reported stronger-than-expected fiscal second-quarter earnings and issued an upbeat outlook.

Shares of Nike (NYSE: NKE) got a boost, shooting up 1.29 percent to $77.85 after the company reported better-than-expected fiscal fourth-quarter earnings. Nike posted its quarterly earnings of $0.78 per share on revenue of $7.43 billion. However, analysts were expecting a profit of $0.75 per share on revenue of $7.34 billion.

The Manitowoc Company (NYSE: MTW) shares were also up, gaining 11.92 percent to $33.25 after Relational Investors bought an 8.5% stake in the company and urged for splitting it in two. Jefferies upgraded Manitowoc from Underperform to Hold and raised the price target from $24.00 to $33.00.

Equities Trading DOWN

Shares of Commercial Metals Company (NYSE: CMC) were 3.81 percent to $17.40 on FQ3 results. Commercial Metals posted a quarterly profit of $23.6 million, or $0.20 per share, versus a year-ago profit of $19 million, or $0.16 per share.

E. I. du Pont de Nemours and Company (NYSE: DD) shares tumbled 4.15 percent to $64.89 after the company cut its profit guidance for the second-quarter and year.

Dollar General (NYSE: DG) was down, falling 6.92 percent to $57.40 after the company’s CEO Rick Dreiling announced his plans to retire.

Commodities

In commodity news, oil traded down 0.20 percent to $105.63, while gold traded up 0.17 percent to $1,319.20.

Silver traded up 0.22 percent Friday to $21.11, while copper fell 0.20 percent to $3.17.

Eurozone

European shares were mixed today.

The eurozone’s STOXX 600 rose 0.03 percent, the Spanish IBEX Index dropped 0.26 percent, while Italy’s FTSE MIB Index slipped 0.30 percent.

Meanwhile, the German DAX climbed 0.11 percent and the French CAC 40 tumbled 0.06 percent while UK shares gained 0.42 percent.

Economics

The final reading of Reuter's/University of Michigan's consumer sentiment index surged to 82.5 in June, versus a final reading of 81.9 in May. However, economists were projecting a final reading of 81.9.

Data on farm prices for June will be released at 3:00 p.m. ET.

Asian stocks fell, with the benchmark index headed for a five-week low, after China�� leaders failed to outline steps to curb state dominance of the economy and amid bets the Federal Reserve may start reducing stimulus next month.

Banks slumped in Hong Kong after a communique at the end of China�� four-day plenum made scant mention of financial reforms. Tencent Holdings Ltd., China�� biggest Internet company, fell 4 percent after a news report quoted its chairman saying the company�� valuation is ��carily��high. Noble Group Ltd. lost 2.8 percent in Singapore after Asia�� largest commodity trader by sales said profit slumped. Pioneer Corp. surged 22 percent after the Japanese maker of car stereos posted an unexpected first-half operating profit.

The MSCI Asia Pacific Index dropped 0.9 percent to 138.50 as of 5:19 p.m. in Tokyo, poised for its first decline in three days and the lowest close since Oct. 8. All 10 industry groups on the measure fell.

    Answer: The Canadian wireless industry is in upheaval right now. The government is doing everything it can to prop up a fourth national carrier, and Rogers is widely seen as the incumbent most susceptible to new competition. That being said, the selling has gotten a bit severe.

    I would favor the US duopoly, Verizon and AT&T, right now. Upstarts down here, including Sprint Corp (NYSE: S) and T-Mobile US Inc (NYSE: TMUS), are still overcoming internal challenges, and while their network potential is significant, based on spectrum licenses held, etc, the Big Two have extreme advantages in terms of ability to invest right now.

Shares of tech titan Google  (NASDAQ: GOOGL  ) (NASDAQ: GOOG  )  are up a bit after it kicked off its developer conference today. According to Motley Fool analyst Simon Erickson, this is Google's chance to get developers excited about creating products for the company's Android platform

New flavor of outsourced fiduciary for retirement plans hits the market

Retirement plan service providers want to up the ante in the world of outsourced fiduciary services, touting the latest flavor: an ERISA 3(16) fiduciary plan administrator.

This latest service offering is popping up in an era when plan sponsors have a heightened awareness of their fiduciary responsibilities and are looking to offload some of them so that they can get back to the day-to-day work of running their business. Plan sponsors already can work with certain financial advisers and investment management firms either to share fiduciary duty under Section 3(21) of the Employee Retirement Income Security Act of 1974 or to hand over the investment management duties under Section 3(38).

“Over the last decade or so, plan sponsors have become more aware of the fiduciary liability and responsibilities, so we've seen more services where plan sponsors can outsource fiduciary responsibility to an entity who will monitor the investments or assist in choosing them,” said Rebecca Kaplan, fiduciary compliance consultant at The Angell Pension Group, a third-party administrator.

That interest has heated up.

“In the last 18 months, we've seen a significant increase in activity,” noted Jeff M. Atwell, senior vice president and manager of the trust retirement division at American National Bank of Texas, which provides fiduciary plan administrator services. “Plan sponsors are becoming more informed about their responsibilities, and this is falling in line with what they're doing to comply with other regulatory issues a business owner has to deal with today.”

But there are potential traps for plan sponsors when it comes to relying heavily on outsourcing those duties.

“When plan sponsors use these services, they start to believe they have no continued responsibility to choosing investments, which of course is a fallacy,” Ms. Kaplan said last month at the National Association of Plan Advisors 401(k) Summit in New Orleans.

The newest flavor of fiduciary duty under Section 3(16) of ERISA includes a variety of tasks: choosing, evaluating and monitoring trustees, service providers, investments and the investment adviser to the plan. They also include evaluating the plan's fees and delegating responsibilities to other fiduciaries.

The 3(16) plan administrator fiduciary holds the keys to the retirement plan's day-to-day operation: He or she is responsible for timely reporting and disclosure of participant fee disclosures and Form 5500. This person also handles distributions of benefits and administers plan loans and qualified domestic relation orders.

Not all 3(16) fiduciary services are built equally.

Fiduciary “lite” for 3(16! ) includes taking transactional burdens off of the plan sponsor and acting as the quarterback. This means overseeing distributions, loans and any other activity that will alleviate the pressure on the employer's office manager, according to C. Frederick Reish, a partner at Drinker Biddle & Reath's employee benefits and executive compensation practice group.

Full-scope 3(16) fiduciary services include decision making, rather than merely lightening the administrative load — for instance, determining whether a domestic relation order is qualified. They also may ensure that elective deferrals are made in a timely manner and ensure that the plan retains its tax-qualified status with the IRS.

“Read the fine print,” Mr. Reish said, referring to the services outlined by a provider of these services. “If they're a 3(16) for less than seven or eight things, then they're 3(16) 'lite,'” he added. “3(16) for everything else would include a robust list of 20 to 30 duties.”

So far, the realm of 3(16) is looking more like the domain for third-party administrators, rather than financial advisers. But advisers working with retirement plans play a key role in screening potential candidates for these outsourced services.

“They can help with the oversight: What experience and expertise does the firm have? Do they know ERISA? What's their privacy policy?” noted Joe Frustaglio, vice president of private sector retirement plan sales for Nationwide Financial.

Other issues for the plan sponsor and adviser to ponder: What kind of insurance coverage does the 3(16) service provider have? Does the provider have a fidelity bond per Labor Department rules that insures 10% of plan assets up to a maximum of $500,000 or $1 million if there's company stock?

Bear in mind that this fidelity bond only covers theft of plan assets and nothing else — it's separate from fiduciary insurance that covers breach of fiduciary duty, said Gary Sutherland, chief executive of North! American! Professional Liability Insurance Agency. TPAs may also assume that errors-and-omissions coverage will include the 3(16) services they provide, but most of these policies will exclude coverage pertaining to being a named fiduciary in a retirement plan.

The biggest lesson for advisers and plan sponsors: Outsourcing 3(16) duties or other fiduciary tasks don't let the plan sponsor off the hook if the provider of those fiduciary services misbehaves. There is no such thing as completely outsourcing fiduciary liability, and plan sponsors still have the responsibility of choosing and monitoring their service providers.

“The best thing for advisers to understand is that it's a fiduciary decision to choose that 3(16) provider and to monitor them,” said Ms. Kaplan. “They need to help the plan sponsor understand the responsibilities so that when they choose a 3(16) service provider, the employer knows which duties they've delegated and which duties they will continue to have.”

Bacterin International Just Sealed the Deal on its Reversal (MDXG, NUVA, BONE)

It may not be as big as NuVasive, Inc. (NASDAQ:NUVA), and it might not be as sexy as MiMedx Group Inc. (NASDAQ:MDXG). But, Bacterin International Holdings Inc. (NYSEMKT:BONE) offers something to investors that MDXG and NUVA don't - can't - right now... a distinct opportunity for a lot of upside in a short amount of time.

For those not familiar with the company, Bacterin International Holdings is predominantly a tissue bank for allograft procedures. Though it's not necessarily its focal point, yesterday's announcement from BONE that it was launching a new allograft product for spinal applications underscores how it competes almost head-on with the aforementioned NuVasive (which is primarily a spinal allograft player) as much as it competes with MiMedx Group, which is more of a generalist, though an impressive generalist.

How well Bacterin International Holdings stacks up against NuVasive, Inc. or MiMedx Group Inc. isn't the important part of the story right now, however. No, the important part of the story here is how the shape of the BONE chart today suggests Bacterin shares have wiggled their way into a full-on breakout mode.

The daily chart of BONE lets us see how the stock finally popped above a major ceiling at $0.80 today. It had bumped into that line - give or take - four different times since August, but had never been able to move above it. As of today (Wednesday), however, the bulls finally shoved it past that resistance. Now that it's out of the way - especially now that all of the key moving average lines have crossed one another in a bullish direction - the stock should be able to move higher much more freely.

To really put the turnaround from Bacterin International Holdings in perspective, however, you have to take a step back and look at a weekly chart of BONE. It's here we can see just how big of a deal it is that the stock managed to move above the 200-day moving average line (green) earlier in the year, after being unable to do so for the better part of 2012 and all of 2013 despite several attempts during that time. This really is a paradigm shift, complete with a higher low and as of today, a higher high.

Hot Restaurant Companies To Buy For 2015

With all of that being said, know that the company is set to release last quarter's earnings results after the close today. That will be a catalyst, for better or worse, and it may well be the prod for the sudden strength we're seeing from Bacterin International Holdings Inc. today. What does a trader do about it? At this point, the smart move may be doing nothing until the dust settles after earnings.

The market has already spoken, pre-earnings. If earnings are seen as poor that could hit the stock, but the undertow has already been revealed as bullish. If instead the market likes what it hears from Bacterin after the close today and bids it up, that may well drive BONE into an overbought condition it's going to have to burn off anyway... with a pullback. Either way, newcomers should wait, and either way, the bigger trend has already been confirmed as a bullish one. The only real challenge  from here is timing the entry.

The pain of missing out on the tripling of the U.S. stock market since March 2009 has become almost unbearable for many investors who have been watching from the sidelines, financial advisers say.

Some who got out of stocks five years ago are fixating on how much richer they would have been if they had stayed put. Others are suffering the social distress of listening to friends bragging about their bigger returns.

Psychologist Daniel Kahneman, who won the Nobel Prize in economics in 2002, likes to say that one of the keys to investing successfully is properly anticipating your regret.

Learning from other people's remorse now may help you minimize your own later—by learning how to reframe your regrets and by making gradual changes to your investing plan that are likely to keep you from doing anything rash.

Jim MacKay, of MacKay Financial Planning in Springfield, Mo., says two couples who are new clients of his firm both took nearly all their money out of U.S. stocks in late 2008 and early 2009 and have kept it in cash ever since.

After U.S. stocks returned 32% last year, Mr. MacKay says, these couples are asking themselves, "Uh-oh, what have we done?" They asked to put at least half their money back into stocks—all at once.

Several other financial advisers told me this past week about clients who are chafing to move most or all of their money into stocks. Often, those who lost the most in 2008 and 2009—and begged to be taken out of stocks entirely—are the most eager to pile back in now.

"Some investors have an overwhelming, self-defeating desire to adjust their asset allocation based on recent past results," says Frank Armstrong, president of Investor Solutions, a financial-advisory firm in Miami. "While markets are reasonably efficient, many investors are hopelessly inefficient."

Recent returns can distort your behavior for different reasons. If you have been riding the market's upsurge, you may feel as if you can afford to take extra risks with “house money,” or profits in excess of your own capital—much the way casino gamblers tend to bet more aggressively after a big score.

Conversely, if you have missed out, you may chase the rising market in a desperate attempt to get back to "break-even," or the level of wealth you would have had if you had stayed in all along.

Recent gains or losses change how the human brain assesses risk, according to a study that will appear later this year in a well-regarded psychology publication, the Journal of Economic Behavior & Organization.

People were roughly 20% more likely to take a gamble after either a gain or loss than after a neutral outcome, the study shows. During the experience of profits and losses alike, several regions of the brain involved in emotion became more active, while activity dwindled in areas devoted to executive decision-making.

"The experience of gain or loss appears to reduce your deliberation, how much you think about and pay attention to your decisions," says neuroeconomist Kaisa Hytönen of the Aalto University School of Science in Espoo, Finland, the lead author of the study. "That relative lack of deliberation may be driving you to take more risk in your future choices."

In this experiment, a loss didn't mean going into the red—just missing out on a bigger gain. Earlier research has demonstrated that a near miss can prod you into taking much bigger risks than you might otherwise have been willing to run.

How can you take some control over your investing regrets?

First, engage in what Eric Johnson, a psychologist and director of the Center for Decision Sciences at Columbia Business School, calls "therapeutic reframing," or looking at the same evidence from a different angle.

If you are kicking yourself for having gotten partly out of stocks, focus on the fact that you didn't get out entirely. Instead of lamenting how much higher your returns would have been over the past five years if you hadn't reduced your stock exposure in 2008 or 2009, take a moment to calculate how much lower your performance would have been had you sold out completely.

And if you feel you absolutely must buy more stocks to catch up, do so gradually by tiptoeing in over the next year or two in equal monthly installments—as Mr. MacKay, the financial planner, is doing for his clients.

That is especially important when you bear in mind that U.S. stocks fell 57% between 2007 and 2009; if you couldn't stand that pain then, you have no business clamoring to buy stocks now.

Tiptoeing your way back in, rather than plunging in with both feet, will leave you with a lot less regret if the market goes off a cliff like that again.
